1.1. These Terms (hereinafter referred to as the Terms) govern the collection and processing of personal data of any individuals when they use a website hosted on a domain name. https://www.zinda.tj/ in the information and telecommunication network "Internet" (hereinafter referred to as the Site).
1.2. The Conditions have been developed in order to ensure compliance with the requirements of the Law of the Republic of Tajikistan dated August 3, 2018, No. 1537 "On Personal Data Protection" and other regulatory legal acts of the Republic of Tajikistan.
1.3. The User's use of the Site's resources means his/her unconditional acceptance of the Terms.
2.1. The Operator is Closed Joint Stock Company (CJSC) Microcredit Deposit Organization (MDO) “Zinda Capital" (address: 175 Rudaki Ave., 734003, Dushanbe, Republic of Tajikistan).
2.2. Use of the Site's resources is any User's action on the Site, including, but not limited to, viewing materials and information posted on the Site, using the Site's functionality, sending applications / requests / requests through and/or using the Site's forms, uploading scanned copies and/or images of documents, entering information, including, but not limited to, by filling out various forms on the Website, registering in a personal account (creating an account) on the Website.
2.3. Customer is a concept that covers: a) an individual - a user of the website who has concluded a contract with the Operator for the provision of relevant services; or b) an individual using the website who is a representative of a legal entity that has concluded a contract with the Operator for the provision of relevant services.
2.4. Collection of personal data (or collection) - actions aimed at obtaining Personal Data.
2.5. Personal data processing (or processing) - actions aimed at recording, systematization, storage, modification, addition, extraction, use, transfer to third parties, including cross-border transfer, dissemination, depersonalization, blocking and destruction of Personal Data.
2.6. Collection and processing of personal data using automation tools - collection and processing of personal data using computer technology.
2.7. The subject of personal data is an individual to whom Personal Data relates.
2.8. Personal data - information about facts, events, and circumstances of the personal data subject's life. For the purposes of the Terms, Personal Data includes the information specified in clause 4.1. of the Terms.
2.9. The User is the subject of personal data who uses the resources of the Website.The User can also be a Client.
2.10. The User's device is an electronic computer through which the User uses the resources of the website.
2.11. Destruction of personal data - actions as a result ofwhich it is impossible to restore personal data.
2.12. Cookie is a piece of data sent by an Internet site and stored on the User's Device. Cookies usually contain the name of the website from which they were received, the "expiration date" (that is, how long they will remain on the device) and a unique number generated randomly.
2.13. An IP address is a unique address on the network required to locate, transmit, and receive information from one network node to another.
2.14. Cross-border transfer is the transfer by the Operator of the User's Personal Data to the territory of foreign states.
3.1. The Operator collects and processes the User's Personal Data using automation tools.
3.1.1. The User's Personal Data is collected by the Operator as a result of the following actions on the Website:
- viewing materials and information posted on the Website;
- use of Website functionality;
- sending applications / requests / requests through and (or) using the forms of the Website;
- uploading scanned copies and/or images of documents;
- entering information, including, but not limited to, by filling out various forms on the Website;
- registration in your personal account (account creation) on the Website;
- any other User action on the Site.
3.2. The list of actions performed by the Operator with the User's Personal Data includes: Collection of personal data and (or) Processing of personal data.
3.3. The collection and processing of the User's Personal Data is carried out with his consent, except in cases provided for by the legislation of the Republic of Tajikistan. 3.3.1. If the User's Personal Data is classified as information constituting a banking secret, the transfer (including cross-border transfer) of such data to third parties will be carried out in accordance with the norms of the legislation of the Republic of Tajikistan regulating the procedure for disclosing banking secrets.
3.4. The fact that the Site and/or its resources are used by the User means his/her unconditional consent to the collection and processing of Personal Data of the User by the Operator.
3.5. Consent to the collection and processing of the User's Personal Data is considered provided to the Operator from the moment the Use of the Site's resources begins and is valid until the User withdraws it in writing.
3.6. Cross-border transfer of Personal Data is carried out in compliance with the conditions stipulated in Article 18 of the Law of the Republic of Tajikistan dated August 3, 2018, No. 1537 "On Personal Data Protection".
4.1. The Operator collects and processes the following Personal Data ofthe User:
- last name, first name, patronymic (if any); mobile phone number;
- email address;
- The IP address of the User's Device;
- information stored in cookies;
- information about the browser through which the Site resources are used;
- the operating system of the User's Device;
- the number of pages viewed by the User;
- the history of requests and views on the Site and/or its services;
- the length of the User's stay on the Site;
- the queries that the User used when navigating to the Site;
- the pages from which the traffic was made;
- information about the User's Device itself, including the device identifier (if available), session identifier,
- information about the User's online activities using the Site, and other technical information transmitted by the User's Device;
- any other information provided/disclosed by the User, including, but not limited to, by filling out various forms on the Site.
4.2. The amount of the User's Personal Data collected by the Operator depends on the actions performed by the User on the Website.
5.1. The Operator collects and processes the User's Personal Data for the following purposes:
1) providing the User with targeted information on the Operator's products and services;
2) accepting the User for services on the terms stipulated by the legislation of the Republic of Tajikistan;
3) providing services to the User on the terms stipulated by the legislation of the Republic of Tajikistan;
4) providing access to the Internet Banking service;
5) providing feedback;
6) providing full-fledged functioning, improvement of the work and security of the Site;
7) conducting statistical, marketing and other research, including the study (analysis) of user behavior (experience) on the Site and the reasons for its changes.
5.2. The Operator informs the User that according to Part 2 of Article 8 of the Law of the Republic of Tajikistan dated August 3, 2018, No. 1537 "On Personal Data Protection", the collection and processing of personal data should be limited to achieving specific, predetermined and legitimate goals. Processing of personal data incompatible with the purposes of their collection is not allowed.
6.1. The terms of processing and storage of Personal Data for each of the purposes of collecting and processing Personal Data specified in clause 4.1. are set taking into account compliance with the requirements defined by the legislation of the Republic of Tajikistan, including, but not limited to, the Law of the Republic of Tajikistan dated March 15, 2023, No. 1950 "On Countering the Legalization (Laundering) of proceeds from crime, financing of terrorism and financing the proliferation of weapons of mass destruction."
6.2. The Operator takes the necessary measures to protect personal data, ensuring the solution of the following tasks:
- prevention of unauthorized access to the User's Personal Data;
- timely detection of unauthorized access to User's Personal Data;
- minimizing the adverse effects of unauthorized access to the User's Personal Data
6.3. The User's personal data is subject to destruction by the Operator:
- in case of achievement of the purposes of their collection and processing, unless otherwise provided by the legislation of the Republic of Tajikistan;
- upon termination of legal relations between the Operator and the User, unless otherwise provided by the legislation of the Republic of Tajikistan;
- in other cases stipulated by the Law of the Republic of Tajikistan dated August 3, 2018, No. 1537 "On Personal Data Protection".
7.1. The Terms and Conditions come into force from the moment they are posted
on the Website.
7.2. If the event of any dispute regarding the interpretation of the provisions of the Terms, the text of this document in the Tajik language shall prevail over the texts of this document in other language.
7.3. All issues related to the collection and processing of the User's Personal Data, which are not reflected in the Terms, are regulated in accordance with the provisions of the legislation of the Republic of Tajikistan.
7.4. The Operator has the right to unilaterally amend the Terms and Conditions. When making changes to the current version, the date of the last update is indicated. The new version of the Terms comes into force from the moment it is posted on the Website, unless otherwise provided by the new version of the Terms. The current version is always available on the Website.
